TERMS OF SERVICE

These Terms apply to purchases made through 41spice.com.

1. PRODUCTS We sell traditional food products and gift sets. Product photographs, packaging and colours may vary slightly between production batches. We take reasonable care to ensure descriptions, quantities, weights, prices and images are accurate. All products are sold as food products only. Nothing on this website is intended as medical advice or as a claim that a product can diagnose, prevent, treat or cure any condition.
2. INGREDIENTS AND ALLERGENS Please review the ingredients, allergen information and storage instructions on the relevant product page before ordering. Anyone with allergies, intolerances, dietary restrictions or medical conditions, or who is pregnant or taking medication, should seek appropriate advice where necessary. Ingredient and allergen information is also provided on or with the product packaging.
3. ORDERS AND CONTRACT FORMATION Submitting an order is an offer to purchase the selected products. After you order, we send an order-confirmation email. A contract is formed when we accept and begin processing the order. We may decline or cancel an order where payment is not authorised, an item is unavailable, there is an obvious pricing or description error, we suspect fraud, or we cannot legally or practically deliver to the address supplied. If we cancel after payment, we issue a full refund.
4. PRICES AND PAYMENT Prices are shown in pounds sterling unless otherwise stated. The price charged is the price shown when the order is submitted, together with any clearly disclosed taxes or delivery charges. Future price changes do not affect an order already accepted. Payment must be completed through a method available at checkout.
5. DELIVERY Orders are shipped in accordance with our Shipping Policy. Delivery dates are estimates unless we have expressly agreed a specific date. Goods remain our responsibility until delivered to you or a person nominated by you.
6. CANCELLATION, RETURNS AND REFUNDS These are explained in our Return and Refund Policy. Nothing in these Terms limits rights available to consumers under applicable law.
7. DAMAGED, FAULTY OR INCORRECT PRODUCTS Products should be of satisfactory quality, match their description and be fit for their normal purpose. Contact hello@41spice.com if an order arrives damaged, faulty or incorrect. We may ask for photographs or other reasonable evidence to resolve the issue.
8. WEBSITE AVAILABILITY AND ACCURACY We may update website content, product availability and prices. We do not guarantee the website will always be available without interruption and may suspend access for maintenance, security or technical reasons.
9. INTELLECTUAL PROPERTY Unless otherwise stated, the website design, original photography, written content and 41 Spice branding belong to Topcuer Commerce LLC or are used with permission, and may not be copied or used commercially without written permission.
10. LIABILITY Nothing in these Terms excludes or limits liability where doing so would be unlawful, including for fraud, personal injury caused by negligence, or consumer rights that cannot legally be excluded. We are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for losses arising from commercial use of products purchased as a consumer.
11. GOVERNING RIGHTS These Terms do not remove mandatory consumer protections available in the country where the customer lives.
